Depending on your home, you might not need all of these documents. However, pay particular attention to Number 2.

Historically, these were paper documents, but significant changes have occurred in NSW. Legislation in 2021 effectively abolished paper Certificates of Title, moving NSW to a fully electronic land titles system. The land register itself is now the definitive record of land ownership. In the past, if a property was mortgaged, the lending institution (e.g., a bank) would typically hold the physical Certificate of Title as security. However, with the move to electronic titles, this practice has changed. Now, the information is held electronically within the NSW Land Registry Services (NSW LRS) database. Now, even with a mortgage, you will not physically hold a paper certificate. The electronic register will show the mortgage on the property.

2. ATO Clearance Certificate (new regulations): An ATO Clearance Certificate confirms that a property seller is an Australian resident for tax purposes. If a seller doesn’t provide this certificate, the buyer is legally required to withhold a portion of the purchase price and send it to the ATO. Note: The withholding rate has increased to 15% of the total purchase price. This is up from 12.5%. The ATO now requires more identification and tax documents from applicants to verify their residency. Due to stricter checks, processing applications may take longer, potentially up to 28 days.

Any seller of residential or commercial property needs to apply for a Clearance Certificate unless they are exempt under tax laws. If you fail to provide a clearance certificate, you won’t be able to retrieve the monies withheld until you file your tax return.

Regulations regarding this certificate can change, so it’s crucial to consult with your agent or solicitor for the most up-to-date information and how to apply. On a positive note, a clearance certificate is valid for 12 months.

3. Contract of Sale: This is the most crucial document in the entire selling process. It outlines the terms and conditions of the sale, including the purchase price, settlement date, and any special conditions. Your solicitor will draft this document, and your real estate agent will ensure it is presented to potential buyers.

4. Green home/energy efficiency rating: If your home has been certified as environmentally friendly, this certification can be a valuable selling point. It showcases the energy efficiency and sustainability features of your property. Most appraisals need to evaluate the home’s efficiency, giving it a rating from 1 (low) to 10 (highest). While not always mandatory for existing homes, obtaining an energy rating can be a valuable selling point. Note: Improvements to your home’s insulation, windows, and overall design can enhance its energy efficiency. Keep in mind that regulations for energy efficiency are evolving, so it’s vital to stay updated.

8. Drainage diagram: This diagram, while not essential, shows the location of stormwater and sewer pipes on your property. It’s useful for buyers to understand the drainage system and any potential maintenance issues.
